Our Geek of the Week answered:
This is Ellis Wayne Felker. He was accused of murder in Georgia in 1981. Evidence indicated that he was under surveillance at the time of the victim’s death which strongly suggested that Mr. Felker was not the correct suspect. In September of 1996, Felker’s counsel was able to obtain previously withheld evidence including hair samples that were never subjected to DNA analysis. Appeals were made to the Georgia Supreme Court. Not only did they not grant a new trial, they didn’t even grant a stay long enough to allow defense counsel to explore other potential evidence. Mr. Felker executed in November 1996. After the execution in 2000, lawyers obtained a court order for a posthumous attempt at exoneration via DNA testing of the hair evidence. This was the first such posthumous DNA testing done after an execution. The results were inconclusive in establishing whether the hair evidence was that of Mr. Felker or not. This finding should have resulted in a new trial.
