The saddest aspect of life right now is that science gathers knowledge faster than society gathers wisdom.
― Isaac Asimov
One of the beautiful things about science is that it is supposed to be objective. It is frequently said that science “doesn’t have a dog in the fight.” It is emotionless. It is free from bias. It exists independent of our wishes, thoughts and dreams.
But in DUI defense, is it?
Jeremy Brehmer, Esquire and Josh Lee, Esquire both stellar DUI defense attorneys tell the unscientific tale of Tri-Tech Forensics
Attorney Brehmer shares this with us this:
And they further did this—
Josh Lee tells a similar story. He shares, “I spoke to them on the phone and they literally told me that the inserts are different for every state and that they put in the instructions whatever the individual state tells them to put in the instructions. I did get out of them that they purchase their tubes from Kendal Health and then just rebrand them. Unable to get a return call from Kendal Health thus far. Next step is to contact them and get their instructions and then attack Tritech for changing them without reason other than we were asked to by the government.”
Shame on them.
You can’t convince a believer of anything; for their belief is not based on evidence, it’s based on a deep seated need to believe.–Carl Sagan
P.S. (08/10/2012) Josh D. Lee, Esquire wanted to replicate this experiment. So he ordered. He got this in return.

Could I purchase the instructions that your company gives in the proper way to use gray top tubes? Or more specifically, instructions on inversions. Surely that is not a secret also, BD places their instructions on their web page. For example: http://www.bd.com/vacutainer/pdfs/plus_plastic_tubes_wallchart_tubeguide_VS5229.pdf

And there is even more in reply…. (it’s an email so read from bottom to top)
Just in case you can’t make out the email it reads:

I guess that I do not understand completely.
It seems to me that the gray top tubes are part of a scientific process and therefore should have a standardized method of use that is universal across all fields of science and across the entire US. Tritech being the manufacturer (or rebrander as I understand it, correct me if I am wrong) would surely have 1 recommended set of instructions or something similar that was developed in a scientific manner or process. Do you not have such a thing? Again, like BD does here where they say to invert the tubes 8 times: http://www.bd.com/vacutainer/pdfs/plus_plastic_tubes_wallchart_tubeguide_VS5229.pdf
If I could bother you for just another moment: I have been told by your company before that you write instructions differently for each state and in whatever way that particular state wants you to write them. Please correct me if I am wrong. This would make more sense to me if true because that would be why you told me to contact my local state police. Am I following correctly?
Thank you for your assistance.
Sincerely,
Josh D. Lee==============================================================================

We do not sell our instruction sheets. If you need information pertaining to a specific kit, I am sure you can obtain that information from your local state police.
